On August 11, 2007, in Lancashire's Stubbylee Park, Sophie Lancaster and her boyfriend Robert Maltby were violently attacked by a group of teens who disapproved of their gothic appearance. The assailants targeted them based on their clothing and appearance, leading to a brutal assault near a skatepark. The attackers struck Robert, causing him to lose consciousness, and then turned their aggression towards Sophie. Herbert, shockingly, managed to access social media from his prison cell, where he exhibited what Sophie Lancaster's mother perceived as "haughty" and "selfish" behavior. In 2020, Herbert's sentence was reduced by one year due to his allegedly "exemplary" behavior in prison, making him eligible for parole in February 2022.
