MAN GETS 100 YEARS FOR ACCIDENTALLY KILLING HIS 8-YEAR-OLD DAUGHTER WHILE TRYING TO SHOOT HIS 18-YEAR-OLD SON

 


In a tragic and heart-wrenching case, a Montana man, Tony Louis Valez, was sentenced to 100 years in prison for the unintentional shooting and killing of his 8-year-old daughter. The incident took place in Helena, and it resulted in a devastating loss for the family.


Valez learned of his sentence from Lewis and Clark District Court Judge Mike Menahan. In September, he had pleaded guilty to one count of deliberate homicide, a charge that stemmed from a horrifying event that occurred on July 10, 2022. Initially, Valez had faced even more severe charges, including two counts of attempted deliberate homicide and one count of criminal endangerment.


The tragic incident unfolded when Valez believed that two women had come to the house to evict him. In a fit of rage, he grabbed a gun from his bedroom and began shooting. He first aimed at his partner, Heather Hall, until she fell to the ground. He then turned the firearm on his 18-year-old son but missed, inadvertently shooting his 8-year-old daughter, Arianna Valez, who was trying to flee from the gunfire.


Arianna was standing on the back deck at the top of the stairs when she was struck by one of the bullets, causing her to fall off the deck. Despite being rushed to the hospital, she was pronounced dead, leaving her family and the community in shock and mourning.


During the court proceedings, Helena Police Department Sgt. Adam Shanks testified that Valez believed his actions were justified against his partner and son, but he did not initially realize that he had fatally wounded his daughter in the process.


In the sentencing hearing, Valez's attorney requested a 40-year sentence, while District Attorney Kevin Downs recommended a 100-year sentence. Judge Menahan ultimately decided on the latter, emphasizing that he couldn't comprehend how being evicted justified such a violent response, especially with children present. He noted that Valez's actions put everyone's life at risk and were clearly intended to bring harm to the adults present.


Valez, who will be eligible for parole when he is 91 years old, expressed remorse for his actions during the hearing. He acknowledged the irreparable pain and suffering he had caused and conveyed his heartfelt apologies, but he recognized that he could never undo what he had done.


Arianna's mother, Heather Hall, continues to grieve the loss of her daughter and shared the profound impact the tragedy has had on her life. She described the pain as a never-ending nightmare, a constant reminder of her daughter's untimely death.


This heartbreaking case serves as a stark reminder of the devastating consequences of domestic violence and the importance of addressing anger and conflicts through non-violent means. It also underscores the critical need for responsible firearm ownership and safety, especially when children are present in the household. The tragic loss of Arianna Valez will forever haunt her family and community, serving as a somber reminder of the consequences of impulsive and dangerous actions.
